The compatriots contested the new Regulation for the Internal Democracy of Political Organizations approved this week. The issue should be resolved by the TCE.
Once on July 6, the National Electoral Council (CNE) approved and issued the Regulation for Internal Democracy of Political Organizations, with a view to the 2021 elections, groups of migrants contested the resolution because it was intended to prevent the submit nominations from abroad.
On social networks you can see messages such as that the decision of the electoral body is arbitrary and violates the Constitution by violating the rights of migrants.
The actions were carried out at Ecuadorian Consulates such as New York and the United Kingdom. They claim their political participation rights as migrants, because the CNE would be changing the rules of the game to prevent certain political actors from being candidates in the next electoral contest.
A representative of the migrants in the United Kingdom, London, delivered the documentation for the challenge to one of the officials of the Consulate, in order to be sent to Ecuador for the pertinent process by the Electoral Contentious Tribunal (TCE).
The 14-page CNE document reforms the Rules of Political Participation.
She points out that a list complies with the principle of parity when it is made up of equal numbers of women and men. At this point, the Law obliges each political organization to fulfill a mandate of position by placing at least 15% of women at the top of its lists, a percentage that must increase progressively in each electoral process until parity is reached by 50%.
She ensures a 25% participation quota, made up of young people, men and women, which must be applied to the lists of multi-person elections, keeping principles of parity and sequence. The participation of historically discriminated groups such as LGBTI is included.
The document establishes that political organizations must carry out an internal electoral process to choose their pre-candidates. Then this should be socialized to the affiliates and permanent adherents, through their web pages at national, cantonal, parish and foreign levels.
In addition, it requires political organizations to create software to carry out the internal election process, as well as each one to establish its regulations to define its delegates nationally and abroad. Likewise, the organizational conditions of the process that will be supervised by the CNE must be considered.
The delegates of the CNE must sign the act of proclamation of the pre-applications. Then comes the registration for validation. But all this procedure must be carried out through telematic means, due to the health emergency caused by the coronavirus.
The proclamation and acceptance of pre-candidacies will take place 10 days after the election, before the delegates of the National Electoral Council, at the offices of the National Directorate of Political Organizations in the case of national dignities; in Provincial Electoral Delegations, in the case of dignities at the local level; and, in the Consular offices abroad, for the dignity of assembly members abroad.
