Employers and workers must reach an agreement for the payment of wages, according to Minister of Labor

The lack of liquidity of some companies is a drawback.

The Ministry of Labor left the power of employers and workers to reach an agreement for the payment of salaries for this March.

This, because the owners of the companies did not know how to act before the measures implemented by the sanitary emergency caused by the coronavirus pandemic.

In some cases, there are companies where their activities had to completely stop and therefore they would not have income to fulfill that obligation. Meanwhile, others took advantage of teleworking, reduction and modification of the working day.

In these situations, the new Minister of Labor, Luis Poveda Velasco, preferred that the parties reach a consensus.

Until March 25, 89,359 workers were under the type of suspension of the day, most of them work for the manufacturing sector and commerce. This mechanism is contemplated in article 60 of the Labor Code.

This suspension must be notified to the Single Labor Service (SUT) platform, where employers have to indicate the date since this measure is in force, the name of the workers who are going to take advantage of this, and also the recovery days. .

He added that employers must, by law, pay the wages during the interrupted time, but then recover that period by increasing the daily workday to 3 hours, or 4 hours if it is on Saturdays, without any surcharge.

Poveda insisted that there must be an agreement between employers and workers, so that job stability is guaranteed and there are no layoffs.

He added that if this is the case, the employer will be able to tell his worker “look, we are not producing and at this moment I cannot pay you, but I will give you an advance or after the activities are normalized, I will pay you, because even in a crisis, workers’ rights are untouchable ”.

In turn, he appealed to the worker’s sensitivity to the complicated scenario that not only the country, but the world is going through.

In this situation, he also anticipated that in the event that there is no consensus between the parties, the worker has the right to make his claim, although he considered that it may be unofficial in the current situation.

Regarding the reduction of the working day, Poveda indicated that 26,071 workers have joined this modality. Most of the agriculture and livestock sector and administrative services.

Finally, he commented that the issue of payment of contributions to IESS is being analyzed, given the lack of liquidity of some businessmen.
