The causes will be a precedent to generate jurisprudence on Human Rights.
The Constitutional Court will analyze two cases of protective action related to the collective expulsion of foreigners. The Selection Chamber of this entity considered that this situation may generate jurisprudence in the field of Human Rights.
In a statement, the Court explained that the selected cases are related to Venezuelan people, including girls and boys, who entered Ecuadorian territory through an irregular step, who were intercepted by members of the National Police and escorted to Colombia.
The Court’s Selection Chamber considered that with these cases, the State’s obligations regarding the prohibition of collective expulsion of foreign persons may be analyzed.
The Selection Room is made up of the constitutional judges Karla Andrade, Agustín Grijalva and Enrique Herrería.
They recalled that the first case has to do with the expulsion of a group of 22 Venezuelan citizens who crossed the country on February 26, 2019 through an irregular passage, near the international Rumichaca bridge.
The other case occurred on March 13, 2019, in the border town of Urbina. On that occasion, seven people of Venezuelan nationality were arrested by the National Police and ended up expelled into Colombian territory.
Although these issues have already been dealt with by the courts of the Carchi jurisdiction, the Constitutional Court warned that this does not constitute anticipation of criteria for the final decision adopted.
