A Judge of Criminal Guarantees of Tungurahua issued alternative measures to preventive detention against four people for the alleged crime of migrant smuggling.
The elements of conviction presented by the Prosecutor’s Office, in the three hearings held, motivated the magistrate to order Mariana TH, Jesús Tobías SL, Luis Eduardo YP, and William Giovani SU the periodic presentation, the prohibition of leaving the country and the prohibition to dispose of assets, while the tax instruction is developed.
In its Twitter account, the Prosecutor’s Office reported that citizens were detained during an operation carried out in the early morning of this Tuesday, October 27, in the province of Tungurahua.
In the hearings for the formulation of charges, the prosecutor of the Special Prosecutor’s Office for Transnational and International Organized Crime (Fedoti), Alex González, stated that the entity opened three investigations: one on September 18, 2019, and two more on September 18 and 30 September 2020.
In a preliminary manner, it was determined that the defendants had offered their victims trips abroad through illegal companies, facilitating illegal migration.
Among the elements of conviction that justified the initiation of the criminal process are the complaints of the victims, their versions, the recognition of the scene of the events, the audio and video expert technical reports, as well as the certifications of money disbursements made.
Article 213 of the Comprehensive Organic Criminal Code (COIP) establishes that the crime of smuggling of migrants is punishable by a custodial sentence of seven to ten years.
