Constitutional Court gives 3 months for antiretrovirals to be delivered in public hospitals

The IESS and the Ministry of Health must coordinate actions to comply with the supply.

Through a ruling, the Constitutional Court ordered that within a period of three months, the Ecuadorian Institute of Social Security (IESS), in coordination with the Ministry of Public Health (MSP) and the governing authority of the National Public Procurement System ( Sercop) issue standards and adopt pertinent policies for the supply of antiretrovirals in the national health system.

Considering the health emergency due to the pandemic caused by the coronavirus, the Constitutional Court also ordered that the IESS and the Ministry of Health, within a period of 15 days, develop a campaign to disseminate the contingency measures to be implemented, as well as the provisioning of medical care and delivery of antiretrovirals to HIV-positive patients registered in the public health system.

The measure adopted by the entity was notified to the Ombudsman’s Office, in order to monitor it.

The Court ordered the Ombudsman to make monthly and random visits to the health houses of the public network and report each quarter on the measures implemented, as well as on compliance with patient care and the delivery of antiretrovirals.
