Government authorizes contracting works to improve infrastructure in Ecuadorian prisons

Through Executive Decree No. 280, President Guillermo Lasso authorized the National Service for Comprehensive Attention to Adults Deprived of Liberty and Adolescent Offenders (SNAI) the power to contract works inherent to the improvement of the penitentiary infrastructure.

With the document, he delegates to the SNAI the powers for construction, tidying up, restoration, adaptation and modification and incorporation of areas or elements that contribute to their presentation and identification as a public government work built or to be built of the Social Rehabilitation System.

In addition, it grants this institution the following attributions:

  • Open the corresponding contracting file;
  • Determine and apply the respective contracting procedure;
  • Prepare the corresponding contracting specifications;
  • Execute the contracting processes in accordance with the Organic Law of the National Public Procurement System (Sercop);
  • Award the corresponding contracts;
  • Organize the inspection and supervision of the execution of the contracts, and sign the contracts for the provision of inspection services, if applicable;
  • Sign the delivery – reception minutes and carry out the contractual settlements, in agreement with the requesting institution.

The SNAI will have a period of no more than 90 days to carry out the necessary coordination procedures with the Ministry of Transportation and Public Works (MTOP) and with the Ministry of Economy and Finance (MEF).

The decree is issued in the midst of a state of emergency in force in the prison system, after the fourth massacre in the country’s prisons, which occurred between November 12 and 13 of this year. More than 320 inmates have been murdered so far this year only due to violent incidents inside the detention centers.
